Terms of Service

These terms are an agreement between you and the operator of BothSay (bothsay.app), based in Iceland ("we"). By using BothSay you accept them. If you don't agree, don't use the service. You must be at least 13 years old to use BothSay.
1. What BothSay is
BothSay lets a group answer a question without seeing each other's answers, then reveal them at the same time. Rooms are temporary by design: a room and everything in it is permanently deleted within 48 hours of creation, sooner if unused. There are no backups of expired rooms and no way to recover them. Don't use BothSay to store anything you want to keep.
2. Room links and encryption — read this one
Access to a room is controlled by its link. Answers are end-to-end encrypted with a key embedded in the link itself; we never receive the key and cannot read, recover, or reset it. This means: anyone you give the full room link to can join the room and, after the reveal, read every answer in it. You are responsible for who you share links with. If a link (and its key) is lost, the encrypted content is gone — for everyone, including us.
3. Your content
Questions, names, and answers belong to whoever wrote them. You give us only the limited license needed to operate the service: storing, transmitting, and displaying that content to the room's participants, and generating the previews and share images the service offers. We don't claim ownership, we don't read encrypted answers (we can't), and the license ends when the room is deleted.
You are solely responsible for what you write and share. Content in rooms is created by users, not by us, and we do not review, endorse, or verify it.
4. Acceptable use
Don't use BothSay to: break the law; harass, threaten, or defame anyone; share content that sexualizes minors (reported to authorities, always); distribute malware or phishing links; infringe others' intellectual property; send spam; or probe, overload, scrape, or interfere with the service or its anti-abuse systems. We may remove rooms and block access at our discretion to enforce this.
5. Reporting content
Every room has a "Report this room" link — use it to flag illegal or abusive content, or email hello@bothsay.app with the room link. We review reports and remove rooms that break these terms or the law. Because rooms self-delete within 48 hours, most content is gone on its own before long.
6. BothSay Plus
When paid features ("Plus") are available, purchases are processed by Paddle as merchant of record; Paddle's checkout terms and refund policy apply to the transaction, alongside your statutory rights. A Plus purchase can be activated on up to 5 devices. Prices and included features may change; changes never remove what a current subscription period already paid for.
7. The service is provided "as is"
BothSay is provided "as is" and "as available", without warranties of any kind, express or implied — including merchantability, fitness for a particular purpose, and non-infringement — to the fullest extent permitted by law. We don't promise the service will be uninterrupted, error-free, or preserved: we may change, suspend, or discontinue any part of it at any time. During the current preview period especially, things may break or change without notice.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of (or inability to use) BothSay — including anything other users say or do, lost room links, or deleted rooms. Our total liability for all claims combined is limited to the greater of the amount you paid us in the 12 months before the claim or €20. Nothing in these terms limits liability that cannot be limited by law, and if you are a consumer, your mandatory statutory rights in your country of residence are unaffected.
9. Indemnity
If your content or your use of BothSay in violation of these terms causes a third-party claim against us, you agree to cover the reasonable costs and damages arising from that claim.
10. Termination
You can stop using BothSay at any time — there's no account to close, and your rooms delete themselves. We may suspend or terminate access, or remove rooms, where these terms are violated or the service is abused.
11. Changes to these terms
If we change these terms materially, we'll update the date above. Continued use after a change means the new terms apply.
12. Governing law
These terms are governed by the laws of Iceland. If you are a consumer in the EU/EEA, UK, or elsewhere, you keep the protection of the mandatory consumer laws of your country of residence, and you may bring proceedings in your local courts where the law provides for it. EU residents may also use the European Commission's Online Dispute Resolution platform.
